01The proposed agreement

After approval and deliberate acceptance, the proposed agreement would be between you and frwrd.team LLC, doing business as dks.studio (“dks.studio,” “we,” or “us”). These terms are not yet offered for an external release. The applicable Apple license terms will be identified here after App Store Connect configuration is confirmed.

02What Booka is—and is not

Booka is an interactive fiction and audiobook service that uses your walking progress to pace a story. It is not a navigation, emergency, accessibility-navigation, medical, fitness, or safety service. Routes, ETA, position, and Movement inference can be delayed, incomplete, or wrong. Never rely on Booka where an error could injure someone or cause property loss.

03Walking safely

• Follow laws, signs, closures, property boundaries, weather, lighting, accessibility needs, and real-world conditions over the app.
• Do not look at or handle the phone while crossing, driving, cycling, or whenever doing so is unsafe.
• A story’s “turn left” or “turn right” is a fictional choice cue. It is never permission or proof that a physical path is legal or safe.
• A directional branch is not a promise that a matching walking route exists. Automatic recovery may use a direct route to the unchanged finish.
• Use Buttons, pause, wait for automatic route recovery or replacement, abandon the walk, or call emergency services whenever circumstances require it.
• You are responsible for choosing an appropriate location, route, pace, footwear, visibility, supervision, and device/audio setup.

04AI and synthetic content

Booka can generate plot, branches, prose, and narration with AI services. The source candidate can optionally generate cover art when the backend feature is enabled. AI output can be repetitive, incoherent, inaccurate, offensive, derivative, frightening, or unexpectedly unsuitable. Provenance labels describe the recorded creation process; they are not a promise of quality, originality, copyright protection, or legal clearance.

05Your input and acceptable use

You keep whatever rights you have in a custom premise or feedback. Effective terms would request only the limited permission needed for the operation you choose: processing, requested generation, technical validation, storage and support. This draft itself grants no permission. Creator manuscripts need the separate, versioned creator agreement.

Do not submit private information you do not need to provide; someone else’s personal data or likeness without permission; illegal or exploitative material; instructions to imitate a living artist; protected characters/brands you lack rights to use; or content intended to harass, threaten, deceive, or facilitate harm.

Do not probe for secrets, bypass controls, automate abusive volume, poison statistics, resell beta access, interfere with the service, or use generated output as professional advice.

06Saved stories and downloads

Completed stories and routes are stored locally in the current beta. Offline audio and covers can disappear because of deletion, device storage management, file corruption, an app update, provider/license changes, or removing the app. The current export contains story metadata, provenance, choices, actual elapsed and moving minutes, median walking speed when available, accepted interval count, and route-revision count. It omits the full story, precise route geometry, raw location timestamps, accuracy and speed samples, audio, and artwork. A local download grants personal in-app listening; it does not grant a right to redistribute the story, voice, or artwork.

07Beta availability and changes

Booka is experimental and depends on Apple, maps, hosting, model, voice, and image services we do not control. The service can be changed, rate-limited, paused, or discontinued; a generated request can fail; and beta data can require migration. We will not intentionally charge for a technical failure. The current beta has no paid Booka subscription or credit product.

08Ownership and feedback

Booka, its code, brand, mascot, catalog stories, service prompts, and other product materials belong to dks.studio or their respective licensors. The proposed listening scope is personal use inside the service, subject to applicable rights. Feedback-use permissions and confidentiality must be explained in the approved agreement rather than inferred from this draft.

09Disclaimers and responsibility

To the extent permitted by law, Booka is provided “as is” and “as available,” without warranties that it will be uninterrupted, accurate, safe for a particular route, or fit for a particular purpose. dks.studio is not liable for risks you knowingly take while walking or for indirect, incidental, special, consequential, or punitive damages. Nothing here excludes rights or liability that applicable law does not allow us to exclude.

10Ending access, updates, and contact

We may suspend access for abuse, security risk, or legal necessity. You can stop using Booka and delete local data at any time. Material changes update the date and version on this page. Publishing or reading this draft is not acceptance; an effective agreement requires a deliberate acceptance process.
